4. HOW TO ENTER. You (“Entrant”) may enter the VIRTUOSO LIFE Travel Dreams Sweepstakes presented by Toyota (the “Sweepstakes”) between January 1, 2009, beginning at 9:00 a.m. Central Time (CT) and March 31, 2009, by completing a short online survey (“Entry”) at www.virtuosolife.com. Deadline for submitting Entries is March 31, 2009, at 11:59 p.m. CT. Once submitted, all Entries become the exclusive property of Sponsor and receipt of same will not be acknowledged or returned. Only one (1) Entry per person. When you complete your Entry, you may be asked to consent to receive promotional emails from Sponsor and/or Presenter and information about Sponsor and/or Presenter. Consenting to receive such emails is optional and does not have to be agreed to in order to be eligible to enter the Sweepstakes and does not improve your chances of winning. In the event you do consent to receive these emails, the use of such emails shall be subject to the Sponsor’s and Presenter’s privacy policies. Information collected in connection with the Sweepstakes may be used by Sponsor and/or Presenter in accordance with their respective privacy policies which can be viewed at www.virtuosolife.com/privacy or http://www.toyota.com/html/privacy/.
5. ELIGIBILITY. The Sweepstakes is offered only in the 48 contiguous United States (including the District of Columbia), and is open only to natural persons who, at the time of Entry: (i) are legal residents of the 48 contiguous United States or the District of Columbia, (ii) have pre-existing internet access, (iii) are 21 years of age or older, and (iv) are U.S. licensed drivers. Employees and agents of Sponsor and/or Presenter (collectively referred to as “Associated Persons”) and each of Sponsor’s and Presenter’s parents, affiliates and subsidiaries, advertising and promotional agencies, distributors, wholesalers and retailers, and members of such Associated Persons’ immediate families and individuals living in the same household with such Associated Persons are not eligible to win. Void in Alaska, Hawaii, Puerto Rico, or otherwise outside the 48 contiguous United States and the District of Columbia, and where prohibited or otherwise restricted by law.
6. PRIZE DETAILS. The prizes are as follows: One (1) Grand Prize of one (1) 2009 Toyota Venza (the “Prize Vehicle”), which has an approximate retail value (“ARV”) of $35,000, and five (5) cash Second Prizes of $1,000 each (the “Cash Prizes”). The Prize Vehicle and the Cash Prizes are collectively referred to herein as the “Prizes” or “Prize,” and have a total combined ARV of $40,000. All additional costs, taxes, fees, and expenses associated with any element of a Prize not specifically addressed herein are the sole responsibility of the Prize winner. All federal, state and local taxes on the Prize or the Prize winner’s income are the Prize winner’s responsibility. The Prize winner will be issued an IRS Form 1099 for the ARV of the Prize. The Prizes are non-transferable. No Prize substitution allowed by winner. Prizes shall be delivered to winners only in the 48 contiguous United States (including the District of Columbia). With regard to the Prize Vehicle, Sponsor and Presenter reserve the right to substitute a different vehicle of equal or greater value. The depiction or display of the Prize Vehicle in any advertising or promotional materials or physical display may not reflect the actual vehicle delivered to the Prize Vehicle winner. The Prize Vehicle winner shall be responsible for all taxes, license, title, and registration fees or other costs, including without limitation any travel and transportation costs, associated with transferring and/or winning the Prize Vehicle, provided, however, the Prize Vehicle shall be delivered at no delivery cost to the winner to an authorized Toyota/Lexus/Scion dealer or distributor in the 48 contiguous United States (including the District of Columbia) reasonably close in proximity to the Prize Vehicle winner’s residence. Neither Presenter nor Sponsor shall be responsible for delays in delivery of the Prize Vehicle, and delivery is subject to availability. Presenter, however, shall use all reasonable efforts, subject to availability, to deliver the Prize Vehicle within one hundred and twenty (120) days after receipt of the affidavit of eligibility/liability/publicity release described in Section 7 below. The Prize Vehicle winner shall bear all risk of loss or damage to the Prize Vehicle after it has been delivered to the authorized Toyota/Lexus/Scion dealer or distributor described herein. In order to claim the Prize Vehicle, the Prize Vehicle winner must personally retrieve the Prize Vehicle within thirty (30) days of written notification of delivery and must present adequate personal identification and evidence of legally required insurance, or the Prize Vehicle may be forfeited and awarded to an alternate winner by random drawing from the remaining Entries. The Prize Vehicle will be delivered solely with the express written limited warranties set forth in the Prize Vehicle’s applicable Owner’s Guide, which warranties shall run for the term set forth in said Owner’s Guide, and Presenter shall be solely responsible for such warranties. The Cash Prizes will be delivered to the respective winners by U.S. mail or courier within thirty (30) days after the winners have been finally determined in accordance with these rules.
7. DRAWING AND AWARDING OF PRIZES. On or about April 21, 2009, the Prize winners will be selected in a random drawing from among all eligible Entries received by Sponsor. Sponsor’s and Presenter’s decisions will be final in all matters relating to the Sweepstakes. The potential winners will be notified by phone and/or certified mail. The potential winners will be required to sign and notarize an affidavit of eligibility which affirms that he/she has complied with these rules, as well as a liability release, and where legal, a publicity release, each of which, if issued, must be completed, signed and returned within fourteen (14) days from date of issuance of same by Sponsor, or the Prize will be forfeited and awarded to an alternate winner by random drawing from the remaining Entries. If any Prize, Prize notification or attempted notification is returned as undeliverable, the Prize will be forfeited and may be awarded to an alternate winner by random drawing from the remaining Entries. Except where prohibited by law, acceptance of a Prize constitutes the winner’s consent to the use of his/her name, hometown, testimonial, photograph or other likeness and/or Prize information or personal exposition (and/or any edited portion thereof) without further compensation or notice to, or further consent of, the winner for advertising, promotional and publicity purposes in any media now or hereafter known throughout the world, in perpetuity, by Sponsor or Presenter, to the extent permitted by law.
8. ODDS. There will be six (6) winners: one (1) Grand Prize winner of the Prize Vehicle, and five (5) Second Prize winners of the Cash Prizes. Odds of winning depend upon the number of eligible Entries received.
9. OTHER CONDITIONS. All federal, state and local laws and regulations apply, and the Sweepstakes shall be conducted in conformance therewith. Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes or any portion thereof (or to disqualify any individual implicated in any of the following actions, whether based on suspicion or actual evidence), if, for any reason: (a) infection by computer virus, bugs, tampering, unauthorized intervention, improper actions by Entrants, fraud, technical failures, or any other causes which, in Sponsor’s sole opinion, corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes, (b) the Sweepstakes or any website associated therewith (or any portion thereof) becomes corrupted or does not allow the proper processing of Entries per these rules, or (c) the Sweepstakes is otherwise not capable of running as planned by Sponsor. Should the Sweepstakes be terminated prior to the stated expiration date, notice will be posted at www.virtuosolife.com. Virtuoso, Ltd. is the sole sponsor of the Sweepstakes. By entering, Entrants agree to release and hold harmless Sponsor and each of its parents, subsidiaries, divisions, representatives and affiliates, advertising and promotional agencies, wholesalers and retailers, successors and assigns, and each of the foregoing entities’ employees, officers, directors, shareholders and agents (collectively the “Released Sponsor Parties”), from and against any and all claims, demands, proceedings, suits and actions and/or liability for any injuries or death, loss or damage of any kind arising from or in connection with the promotion of the Sweepstakes, the distribution of any Prize, and/or Entrants’ participation in and/or Entry into the Sweepstakes or acceptance or use of any Prize. Further, by entering, Entrants agree to release and hold harmless Presenter and each of its parents, subsidiaries, divisions, representatives and affiliates, advertising and promotional agencies, wholesalers and retailers, successors and assigns, and each of the foregoing entities’ employees, officers, directors, shareholders and agents (collectively the “Released Presenter Parties”), from and against any and all claims, demands, proceedings, suits and actions and/or liability for any injuries or death, loss or damage of any kind arising from or in connection with the promotion of the Sweepstakes, the distribution of any Prize, and/or Entrants’ participation in and/or Entry into the Sweepstakes or acceptance or use of any Prize (the “Released Sponsor Parties” and the “Released Presenter Parties” may collectively be referred to herein as the “Released Parties”), provided, however, that Presenter shall be solely responsible for any express written limited warranties specifically set forth in the applicable Owner’s Guide for the Prize Vehicle, which warranties shall run for the term set forth in said Owner’s Guide. The Released Parties are not responsible or liable for any incorrect or inaccurate Entry information, and assume no responsibility for (i) any error, omission, interruption, defect or delay in operation or transmission at any website, (ii) failure of any Entry to be received by Sponsor due to technical problems, human error or traffic congestion on the Internet or at any website, (iii) communications line, hardware and/or software failures, (iv) damage to any computer (software or hardware) resulting from participation in the Sweepstakes, (v) theft or destruction of, tampering with, unauthorized access to, or alteration of Entries and/or Entry information, or (vi) Entries which are late, lost, stolen, damaged, and/or unintelligible (or any combination thereof). By entering, Entrants agree to comply with these rules. Any Entrant who attempts to tamper with the Sweepstakes in any way shall be disqualified. In the event of a dispute as to who submitted an Entry, the Entry will be deemed submitted by the Authorized Account Holder of the email address submitted at the time of Entry. “Authorized Account Holder” is defined as the natural person assigned to an email address by an Internet access provider, on-line service provider or other organization responsible for assigning email addresses for the domain associated with the email address in question. Additional restrictions may apply. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR AND PRESENTER EACH RESERVE THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEYS’ FEES TO THE EXTENT ALLOWED BY LAW) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
10. WINNERS’ IDENTITIES. Requests received after August 31, 2009, will not be honored. The names of the winners will be posted on www.virtuosolife.com between July 1, 2009, and August 31, 2009, and will also appear in the July/August 2009 issue of VIRTUOSO LIFE magazine.
