1. NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE YOUR CHANCES OF WINNING.
2.SPONSOR. Virtuoso, Ltd., 505 Main Street, Suite 500, Fort Worth, Texas 76102.
3. PRIZE PROVIDERS. Seabourn Cruise Line Limited, One&Only Resorts Management Limited, Lindblad Maritime Enterprises, LTD, Virgin Atlantic Airways Limited, and/or any additional or substitute Prize Provider designated by Virtuoso.
4. HOW TO ENTER. You (“Entrant”) may enter the 2010 VIRTUOSO LIFE Travel Dreams Sweepstakes (the “Sweepstakes”) between February 1, 2010, beginning at 9:00 a.m. Central Time (CT) and March 31, 2010, by completing a short online survey (“Entry”) at www.virtuoso.com. Deadline for submitting Entries is March 31, 2010, at 11:59 p.m. CT. Once submitted, all Entries become the exclusive property of Sponsor and receipt of same will not be acknowledged. Only one (1) Entry per person. At the time of entry, Entrants must choose the one (1) Prize for which they wish to be eligible: either the Cruise Prize, the Hotel/Air Prize, or the Tour Prize (all of which are described below in Section 6 of these Official Rules and in the Prize Terms and Conditions). When you complete your Entry, you may be asked to consent to receive promotional emails from Sponsor and information about Sponsor. Consenting to receive such emails is optional, is not required in order to be eligible to enter the Sweepstakes, and does not improve your chances of winning. In the event you do consent to receive these emails, the use of such emails will be subject to Sponsor’s Sweepstakes privacy policy. Entrant information collected in connection with the Sweepstakes may be used by Sponsor in accordance with its Sweepstakes privacy policy which can be viewed at www.virtuoso.com/privacy.
5.ELIGIBILITY. The Sweepstakes is offered only in the fifty (50) United States (including the District of Columbia), and is open only to natural persons who, at the time of Entry: (i) are legal residents of the fifty (50) United States or the District of Columbia, (ii) have pre-existing internet access, and (iii) are 21 years of age or older. Employees and agents of Sponsor and/or a Prize Provider and employees and agents of Sponsor’s and/or the Prize Providers’ respective parents, affiliates, subsidiaries, advertising and promotional agencies, distributors, wholesalers and retailers (collectively referred to as “Associated Persons”), members of such Associated Persons’ immediate families, and individuals living in the same household with such Associated Persons are not eligible to win. Void in Puerto Rico or otherwise outside the fifty (50) United States and the District of Columbia, and where prohibited or otherwise restricted by law.
6.PRIZE DETAILS. The prizes are as follows: Cruise Prize: one (1) twelve (12) day The Yachts of Seabourn cruise for two (2) aboard Seabourn Pride sailing from Bangkok, Thailand to Shanghai, China on either July 17 or September 3, 2010, plus round-trip airfare for two (2) from select gateways, which prize has an approximate retail value (“ARV”) of $22,000.00; Hotel/Air Prize: one (1) five (5) night stay for a maximum of two (2) guests in a Marina Room at One&Only Cape Town to include breakfast at maze, a fifty (50) minute massage for two (2), a R700 restaurant voucher and two (2) round-trip Premium Economy Class tickets aboard Virgin Atlantic Airways, non-stop service from any of its U.S. gateways, which prize package has a total ARV of $22,612.00; and Tour Prize: one (1) ten (10) day, nine (9) night trip for two (2) aboard the National Geographic Endeavour to the Galapagos provided by Lindblad Expeditions, plus airfare for two (2) from Miami on select Lindblad group flights, which prize has an ARV of $13,540.00. The Cruise Prize, Hotel/Air Prize, and Tour Prize are collectively referred to herein as the “Prizes” or a “Prize,” and have a total combined ARV of $58,152.00. All amounts are in US Dollars unless otherwise specified. All additional costs, taxes, fees, and expenses associated with any element of a Prize not specifically addressed in these Official Rules (the “Official Rules”) or in the Prize Terms and Conditions are the sole responsibility of the winner. Please see the Prize Terms and Conditions here for additional Prize details. All federal, state and local taxes on the Prize or the winner’s income are the winner’s responsibility. Each winner will be issued an IRS Form 1099 for the ARV of the applicable Prize. The Prizes are non-transferable and cannot be redeemed for cash. No Prize substitution allowed by winner. Sponsor and the Prize Providers reserve the right to substitute a different prize of equal or greater value. The depiction or display of the Prize in any advertising or promotional materials may not reflect the actual Prize delivered to the winner. The winners are responsible for all taxes, fees or other costs, including without limitation any travel and transportation costs and gratuities, associated with the Prize that are not expressly included in the Prize description as specified in the Prize Terms and Conditions. The winners are subject to all requirements, restrictions, and conditions set forth in the Prize Terms and Conditions. The winners must redeem and/or use the Prize within the timeframe (if any) stated in the Prize Terms and Conditions, or the Prize may be forfeited. The Prize Providers are solely responsible for any applicable warranties in connection with the Prizes.
7.DRAWING AND AWARDING OF PRIZES. On or about April 21, 2010, the winners will be selected in a random drawing from among all eligible Entries for each Prize. There will be three (3) separate random drawings, one (1) for each Prize. Sponsor’s decisions will be final in all matters relating to the Sweepstakes, including without limitation, winner eligibility. The potential winners will be notified by phone and/or certified mail. The potential winners will be required to sign and notarize an affidavit of eligibility which affirms that he/she has complied with the Official Rules, as well as a liability release, and where legal, a publicity release, each of which, if issued, must be completed, signed and returned within fourteen (14) days from date of issuance of same by Sponsor, or the Prize will be forfeited and awarded to an alternate winner by random drawing from the remaining Entries. Each winner’s travel companion will also be required to sign and notarize a liability release, and where legal, a publicity release, each of which, if issued, must be completed, signed and returned within fourteen (14) days from date of issuance of same by Sponsor or the travel companion’s ability to accompany the winner may be forfeited. If the travel companion is a minor, the liability/publicity release must be signed by the minor’s parent or guardian. If any Prize, Prize notification or attempted notification is returned as undeliverable, the Prize may be forfeited and awarded to an alternate winner by random drawing from the remaining Entries. Except where prohibited by law, acceptance of a Prize constitutes the winner’s consent to the use and display of his/her name, hometown, testimonial, photograph or other likeness, Prize information, and personal exposition (and/or any edited portion thereof) without further compensation or notice to, or further consent of, the winner for advertising, promotional and publicity purposes in any media now or hereafter known throughout the world, in perpetuity, by Sponsor and/or the applicable Prize Provider, to the extent permitted by law.
8.ODDS. There will be three (3) winners: one (1) Cruise Prize winner, one (1) Hotel/Air Prize winner, and one (1) Tour Prize winner. Odds of winning depend upon the number of eligible Entries received for each Prize. Each Entrant will be eligible for only one (1) Prize.
9.OTHER CONDITIONS. All federal, state and local laws and regulations apply, and the Sweepstakes will be conducted in conformance therewith. Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes or any portion thereof (or to disqualify any individual implicated in any of the following actions, whether based on suspicion or actual evidence), if, for any reason: (a) infection by computer virus, bugs, tampering, unauthorized intervention, improper actions by Entrants, fraud, technical failures, or any other causes which, in Sponsor’s sole opinion, corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes, (b) the Sweepstakes or any website associated therewith (or any portion thereof) becomes corrupted or does not allow the proper processing of Entries per the Official Rules, or (c) the Sweepstakes is otherwise not capable of running as planned by Sponsor. Should the Sweepstakes be terminated prior to the stated expiration date, notice will be posted at www.virtuoso.com. By entering, Entrants agree to release and hold harmless Sponsor and each of its subsidiaries, divisions, affiliates, successors and assigns, and each of the foregoing entities’ employees, officers, directors, shareholders and agents (collectively the “Released Sponsor Parties”), from and against any and all claims, demands, proceedings, suits and actions and/or liability for any injuries or death of any person, or loss or damage of any kind arising from or in connection with the promotion of the Sweepstakes, the distribution of any Prize, Entrants’ participation in and/or Entry into the Sweepstakes, or acceptance or use of any Prize. Further, by entering, Entrants agree to release and hold harmless each Prize Provider and its respective parents, subsidiaries, divisions, affiliates, advertising and promotional agencies, wholesalers and retailers, successors and assigns, and each of the foregoing entities’ employees, officers, directors, shareholders and agents (collectively the “Released Prize Provider Parties”), from and against any and all claims, demands, proceedings, suits and actions and/or liability for any injuries or death of any person, or loss or damage of any kind arising from or in connection with the promotion of the Sweepstakes, the distribution of any Prize, Entrants’ participation in and/or entry into the Sweepstakes, or acceptance or use of any Prize. (The “Released Sponsor Parties” and the “Released Prize Provider Parties” may collectively be referred to herein as the “Released Parties.”) The Released Parties are not responsible or liable for any incorrect or inaccurate Entry or Prize information, and assume no responsibility for (i) any error, omission, interruption, defect or delay in operation or transmission at any website, (ii) failure of any Entry to be received by Sponsor due to technical problems, human error or traffic congestion on the internet or at any website, (iii) communications line, hardware and/or software failures, (iv) damage to any computer (software or hardware) resulting from participation in the Sweepstakes, (v) theft or destruction of, tampering with, unauthorized access to, or alteration of Entries and/or Entry information, or (vi) Entries which are late, lost, stolen, damaged, incomplete, and/or unintelligible (or any combination thereof). VIRTUOSO MAKES NO WARRANTIES IN CONNECTION WITH THE SWEEPSTAKES OR THE PRIZES. VIRTUOSO EXPRESSLY DISCLAIMS ANY IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION, ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. By entering, Entrants agree to comply with the Official Rules and the Prize Terms and Conditions. Any Entrant who attempts to tamper with the Sweepstakes in any way will be disqualified. In the event of a dispute as to who submitted an Entry, the Entry will be deemed submitted by the Authorized Account Holder of the email address submitted at the time of entry. “Authorized Account Holder” is defined as the natural person assigned to an email address by an internet access provider, on-line service provider or other organization responsible for assigning email addresses for the domain associated with the email address in question. Requests received after August 31, 2010, will not be honored.
